Terms of Use

1. What weeBIG Is

weeBIG is a free online property advertising platform. Real estate professionals and other authorized advertisers ("Realtors") can post listings of homes for sale or rent. Each listing shows the Realtor's name, photo or logo, and contact details. Buyers, renters, and other visitors ("Visitors") contact the Realtor directly by email.

weeBIG does not offer "premier agent" or paid placement programs, and we do not sell enquiries or leads to third parties.

2. No Brokerage or Agency Relationship

weeBIG is not a real estate broker, agent, lender, landlord, property manager, appraiser, inspector, or legal or financial adviser. We do not represent any buyer, seller, landlord, or tenant. We do not take part in, negotiate, or guarantee any transaction, and we do not receive commissions or referral fees from any transaction. Any relationship or agreement you form with a Realtor is solely between you and that Realtor.

3. Eligibility

You must be at least 18 years old to create an account or post a listing. The Service is not directed to children under 13, and children under 13 may not use it.

4. Accounts

• You must give accurate, current, and complete information when you register and keep it up to date.
• Realtors must hold any license, registration, or authority required by law to advertise the properties they list, and must comply with the advertising rules of their state licensing authority and any MLS or association they belong to.
• You may only list a property if you have the owner's permission or other legal right to advertise it.
• You are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly at weebigteam@gmail.com if you believe your account has been used without permission.
• One person or business may not create accounts to impersonate someone else or to get around a suspension.

5. Listings Are the Realtor's Responsibility

Realtors are solely responsible for their listings and everything in them, including price, availability, address, size, features, photos, descriptions, and contact details. Realtors must make sure each listing is accurate, lawful, not misleading, and kept up to date, and must remove a listing promptly once the property is sold, rented, or no longer available.

weeBIG does not verify, inspect, or endorse any property or listing. Visitors should independently confirm all information and inspect any property before making decisions.

6. Acceptable Use

You agree to use the Service only for lawful purposes related to advertising or finding residential or other real property. You agree not to:

• post false, misleading, fraudulent, or "bait-and-switch" listings, or listings for property you are not authorized to advertise;
• use the Service to run scams, request advance fees or deposits fraudulently, or collect personal information under false pretenses;
• send spam, bulk unsolicited messages, or messages unrelated to a listing;
• harass, threaten, or abuse any other user;
• scrape, crawl, copy, or harvest listings or contact details by automated means, or use Realtor contact details for any purpose other than enquiring about a listing;
• interfere with or disrupt the Service, attempt to gain unauthorized access, or introduce viruses or other harmful code;
• reverse engineer, decompile, or copy any part of the Service except as allowed by law;
• impersonate any person or business or misrepresent your affiliation with anyone; or
• break any applicable law, including fair housing, consumer protection, privacy, anti-spam (including the CAN-SPAM Act), and real estate licensing laws.

7. Prohibited Content

You may not post or send content that:

• states or implies any preference, limitation, or discrimination based on race, color, religion, sex (including sexual orientation and gender identity), national origin, familial status, disability, or any other characteristic protected by federal, state, or local law (see our Fair Housing Statement);
• is unlawful, defamatory, obscene, pornographic, hateful, violent, or harassing;
• infringes anyone's copyright, trademark, privacy, publicity, or other rights, including photos you do not have permission to use;
• contains other people's personal information without their consent;
• advertises anything other than real property, or promotes illegal activity; or
• contains malware, links to phishing sites, or hidden tracking.

We may, but are not required to, review, edit, refuse, or remove any content, and suspend or close any account, at any time and for any reason, including if we believe these Terms have been broken.

8. Communications Between Users

When a Visitor contacts a Realtor, the enquiry goes to the Realtor by email. weeBIG is not a party to those communications and is not responsible for any Realtor's or Visitor's conduct, replies, or failure to reply. Use caution, and never send money or sensitive financial information before you have verified the person and the property.

9. Intellectual Property

Our content. The Service, including its software, design, text, graphics, and the weeBIG name and logo, is owned by weeBIG Ltd or its licensors and is protected by U.S. and international intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended personal or professional purpose. You may not use our name or logo without our written permission.

Your content. You keep ownership of the content you post, such as listing text, photos, and your logo. By posting it, you grant weeBIG a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, and distribute that content in connection with operating and promoting the Service, for as long as it is on the Service and for a reasonable time afterward for backups and records. You confirm that you have all rights needed to grant this license.

Copyright complaints. If you believe content on the Service infringes your copyright, send a notice to weebigteam@gmail.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material and where it appears; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner. We may remove infringing content and terminate repeat infringers.

10. Third-Party Links and Services

The Service may link to third-party websites or services, such as maps or a Realtor's own site. We do not control and are not responsible for them, and their own terms and privacy policies apply.

11. Disclaimers

THE SERVICE AND ALL LISTINGS AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WEEBIG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT ANY LISTING IS ACCURATE, COMPLETE, OR CURRENT, THAT ANY PROPERTY IS AVAILABLE OR AS DESCRIBED, THAT ANY REALTOR IS LICENSED OR RELIABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEEBIG LTD AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OPPORTUNITY, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, ANY LISTING, ANY PROPERTY, OR ANY DEALINGS BETWEEN USERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some states do not allow certain exclusions or limits on liability, so some of these limits may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless weeBIG Ltd and its officers, members, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content or listings, your dealings with other users, or your breach of these Terms or any law.

14. Termination

You may stop using the Service and ask us to close your account at any time. We may suspend or end your access at any time, with or without notice. Sections that by their nature should survive (including Sections 2, 5, 9, and 11 through 16) will survive termination.

15. Governing Law and Disputes

These Terms and any dispute relating to the Service are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. You agree that any legal action will be brought only in the state or federal courts located in Laramie County, Wyoming, and you consent to the personal jurisdiction of those courts. Before filing any claim, you agree to first contact us at weebigteam@gmail.com and try in good faith to resolve the dispute informally for at least 30 days.

16. Apple App Store Terms

If you downloaded the weeBIG app from the Apple App Store, you also agree that:

• these Terms are between you and weeBIG Ltd only, not Apple Inc. ("Apple"), and weeBIG, not Apple, is solely responsible for the app and its content;
• your license to use the app is limited to use on Apple-branded products you own or control, as allowed by the App Store Usage Rules;
• Apple has no obligation to provide maintenance or support for the app;
• to the maximum extent permitted by law, Apple has no warranty obligation for the app; if the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any);
• weeBIG, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims;
• weeBIG, not Apple, is responsible for investigating, defending, settling, and discharging any third-party claim that the app infringes intellectual property rights;
• you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties;
• you must comply with any applicable third-party terms (such as your wireless data agreement) when using the app; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date and, for material changes, may give additional notice. Your continued use of the Service after changes take effect means you accept them.

18. General

These Terms, together with the policies referred to above, are the entire agreement between you and weeBIG about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, sale, or reorganization.
